
Privacy Week 2026 arrives at a pivotal moment for Australian organisations of all sizes. Rapid changes in how technology is used – particularly the widescale adoption of AI – are driving a tighter regulatory environment, including new transparency obligations for decisions made using automated processes, due to commence on 10 December 2026.
In addition, the Federal Government's National AI Plan confirmed that AI will be governed through existing legislation – principally the Privacy Act – rather than standalone AI-specific laws.
For CIOs, CISOs, and IT leaders, this convergence of AI adoption, changing privacy obligations, and escalating regulatory activity creates both urgency and opportunity. For most organisations with more than $3 million in annual turnover, that means the Privacy Act is already in scope (with some sectors, such as health, subject to stricter requirements).
In practice, staff are already using tools like ChatGPT and Copilot to draft content and analyse information, and business teams may be inputting customer or operational data into models. Without clear governance and technical controls, this can lead to unintended disclosures to overseas servers, third-party processors, or model training datasets.
Under the Privacy Act 1988 and the Australian Privacy Principles (APPs), the organisation remains accountable for personal information handled via third-party AI tools – whether the use is authorised or not. In practice, that includes being transparent when AI is used to process personal information, managing overseas disclosure risk (APP 8), meeting security obligations (APP 11), and ensuring AI-driven analysis doesn’t repurpose personal information beyond the original purpose without consent.
Regulatory announcements only bite when there is meaningful financial consequence. In the context of AI, every instance where personal information is pasted into an external tool may, in theory, constitute a potential Notifiable Data Breach under the Privacy Act. Legal costs average $85,000 to respond to a single data breach, according to one industry analysis1, alongside customer compensation claims and reputational damage that can take years to rebuild.
That risk is being met with more active oversight. In January 2026, the OAIC conducted its first proactive compliance sweep, reviewing approximately 60 organisations across financial services, health, retail, telecommunications, professional services, and digital platforms to assess how AI is being used to handle personal information. It is reasonable to expect these types of sweeps to broaden over the coming year.
Recent case law also underlines the stakes. The first civil penalty under the Privacy Act resulted in a $5.8 million claim against Australian Clinical Labs following a 2022 cyber-attack that exposed sensitive health information of approximately 223,000 Australians. The court made clear that accountability cannot be outsourced: engaging third-party providers – even in response to an incident – does not remove an entity’s privacy obligations.
