Privacy in the Age of AI: From Convenience to Compliance Risk

Privacy Awareness Week (PAW) is an annual event led by the Office of the Australian Information Commissioner (OAIC) to promote the importance of protecting personal information. This year’s PAW runs from 4–10 May 2026 and focuses on “Smart Tech, Smarter Choices: Protecting Your Privacy in the Age of AI.” The campaign highlights privacy rights, responsibilities, and good information-handling practices.

AI is no longer a specialist capability and is used by the vast majority of Australian organisations. However, the tools that streamline workflows, support faster decisions and reduce costs rely on vast amounts of personal and sensitive information to function effectively. If organisations aren’t aware of what information is being captured, how it is used, or where it is stored, this creates significant business risk. What’s more, a privacy failure involving AI is rarely just a legal issue; it quickly becomes a reputational, operational and cyber security risk.

In line with Privacy Awareness Week 2026, we explore how rapid AI adoption is changing privacy from a traditional compliance obligation into a broader business and security risk, and what organisations need to do to stay ahead.

The Growing Business Risks of AI

AI tools are becoming increasingly embedded in everyday workflows. Generative AI platforms are now commonly used to draft emails, summarise documents, analyse spreadsheets, generate reports, support decision-making and more. But while these tools offer clear efficiency gains, they also create new vulnerabilities.

One of the most common and overlooked risks is the rise of “Shadow AI,” where employees use publicly available AI tools without formal approval or governance. Staff can easily upload sensitive customer information, internal documents, financial data, or confidential business information to these platforms, often without understanding security implications. The lack of clear guidance, employee education and proper AI risk assessment creates significant privacy and security risk from the outset.

Once information is entered into an unmanaged AI platform, organisations can lose control over how that data is processed, stored or shared. This can lead to privacy breaches, compliance failures and reputational damage, while also weakening overall data security posture and creating blind spots that traditional controls and data loss prevention (DLP) measures may not detect.

Many organisations already have AI usage policies, privacy frameworks or acceptable use guidelines in place, but they are not consistently enforced. There may be little structure around approved tools, limited monitoring of employee behaviour, and no formal process for assessing AI-related risks before new tools or vendors are introduced. This is where stronger governance, risk and compliance (GRC) frameworks become critical.

Securing Your Organisation’s AI Usage

When AI usage isn’t properly controlled, the impact goes far beyond a privacy breach. Exposure of sensitive data, poor governance or unauthorised use of AI tools can quickly lead to loss of customer trust and confidence, reputational damage, regulatory scrutiny and financial loss.

However, securing AI usage requires more than policy documents; it requires practical controls that prevent risk before it happens and provide visibility when issues arise. Key control areas include:

  • Data Security Solutions: Strong data security services and data loss prevention (DLP) measures work by identifying sensitive information and applying rules that block, restrict, or alert when that data is uploaded, copied, or shared outside approved systems. This gives organisations greater visibility over where sensitive information sits
  • Identity and Access Management (IAM): IAM controls who can access approved AI platforms and what they can do within them. This works through user authentication, role-based permissions, multi-factor authentication and access reviews, reducing unnecessary exposure, strengthening accountability and limiting the risk of both accidental misuse and unauthorised access.
  • Detection of AI Usage: Monitoring and detection tools help organisations identify Shadow AI by showing which AI platforms are in use across the business, what data is being shared, and where risky behaviours may occur. This can include monitoring browser activity, network traffic, SaaS usage and data movement across endpoints.
  • Governance Frameworks: Governance frameworks provide the structure for safe AI adoption by connecting privacy, cyber security and compliance into a clear decision-making process. This includes formal approval for new AI tools, vendor due diligence, defined ownership, regular AI risk assessments and clear accountability for how data is collected, stored and processed.
  • Content Controls: Content controls define what information can and cannot be entered into AI tools and help enforce those boundaries in practice. This may include restricting sensitive keywords, preventing uploads of certain file types, applying data classification labels, or using approved prompt templates to ensure safer use.

Ultimately, securing AI use is not about restricting innovation; it's about building the right structure around it. Strong controls, enforced governance and visibility across AI usage allow organisations to adopt AI confidently, protecting both privacy and long-term business resilience.

Privacy as a Business Imperative in the Age of AI

As AI becomes more deeply embedded in everyday business operations, privacy cannot be treated as a standalone compliance exercise. From Shadow AI and unmanaged data sharing to weak governance and poor visibility over automated decision-making, the risks are now directly tied to customer trust, operational resilience and long-term business reputation.

At the same time, regulatory expectations are continuing to grow. Key examples include Australian government policy on mandatory automated decision-making disclosures, effective from 10 December 2026, requiring organisations to update their privacy policies when personal information is used by computer programs to make, or significantly assist in making, decisions that affect individuals’ rights or interests.

The Australian Government’s Policy for the Responsible Use of AI in Government (Version 2.0) also strengthens expectations around AI governance, requiring transparency statements, AI impact assessments and clear accountability for AI use. Alongside this, OAIC guidance on commercially available AI products reinforces that privacy obligations still apply when using public generative AI tools, particularly around how personal information is shared, stored and processed by third-party platforms.

Privacy Awareness Week 2026 is a timely reminder that smarter technology requires smarter choices. Protecting privacy in the age of AI is not about slowing innovation but about being proactive, reducing risk and creating the right structure for safe adoption.
